BOOKING TERMS & CONDITIONS
1.1 TribeSchoolies.com website is owned and operated by Youth Travel Pty Ltd ACN 626 979 119.
1.2 Please read the following Terms and Conditions carefully as they summarise the basis on which bookings via Tribe Schoolies or Youth ravel are accepted.
1.4 Youth Travel may vary, revise, amend or delete certain conditions and if so will take effect upon being posted on the Tribe Schoolies website.
1.5 If you need further clarification on these Terms and Conditions, please contact Tribe Schoolies prior to making a booking.
1.6 If any dispute arises between you and us, our contract with you is governed by the law of Queensland, Australia. By booking with us you submit to the exclusive jurisdiction of the courts in Queensland, Australia and waive any right that you may have to object to an action being brought in those courts.
2.1 Our booking and services comes with a guarantee that:
• They will be provided with due care and skill.
• They will be reasonably fit for the specified purpose made available to us.
• They can reasonably be expected to achieve the desired result.
• They will be provided within a reasonable time.
2.2 Without affecting any statutory consumer rights that cannot be lawfully excluded or limited, Tribe Schoolies gives no warranties and makes no representations regarding the travel service, events or merchandise provided by the supplier specifically; the usability, fitness of purpose, class, standard, rating or visual images of the related product or service advertised and is not liable for any misleading or false information, misrepresentations, inaccuracies and errors as a result of incorrect information supplied to us by such parties.
3.0 LIMIT OF LIABILITY
3.1 We will not be liable for damages of any kind related to your use of or inability to access this site. Access is not guaranteed and is subject to availability of communications links and access rights. As a user of this website, you must assume full responsibility in the use of our site and you agree that access is undertaken at your own risk.
3.2 We sell travel services, events and merchandise from our service providers and while we take care in selecting the operators for that service, all quotations and reservations are made in accordance with information made available to us by that operator from time to time. We do not accept liability for any costs incurred due to any change in availability, supplier over-selling, third party providers, delays and arrangement changes due to events beyond our control, inclement weather or other acts of God. In addition we do not take responsibility for the conduct or services provided by the operator or their staff.
3.3 We will not be liable for any death, injury, illness, loss of enjoyment, damage, detention, loss due to delays, additional expense, damage or shock associated with any occurrence whilst using the travel service or events provided irrespective of its cause.
3.4 We are not liable to refund any part of the deposit and/or purchase price paid by you if your booking is subsequently changed or cancelled in connection with a Force Majeure event. World weather patterns, civil unrest and terrorism are becoming more erratic and unpredictable and these are risks beyond our control. It is your responsibility to purchase adequate comprehensive travel insurance to protect yourself against these risks.
3.5 Any term, condition or warranty express or implied by Statute or otherwise, for the products and/or services is excluded to the full extent omitted by law. However, nothing in this booking contract excludes, restricts or modifies the application of the Competition and Consumer Act 2010 (Commonwealth) as amended, consolidated, supplemented or replaced.
3.6 To the full extent permitted by law, Tribal Schoolies liability arising under or in connection with this booking contract is limited to the re-supply of the products and/or services or the payment of the cost of the re-supply of the products and/or services to you.
4.0 YOUR OBLIGATIONS AND RESPONSIBILITY
4.1 Your obligations in the use of Website are:
- you are at least 18 years of age
- you possess the legal authority to create a binding legal obligation
- you will only use this Website to make legitimate reservations for you or for another person
- all information supplied by you on this Website is true, accurate, current and complete
4.2 When you make a booking with us, you have entered into a legal obligations and your right to monies charges or refunds to your credit card or paid in any other way agreed by us, are limited by our terms and policies and by the conditions of our travel or event provider.
4.3 We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer, at any time and for any reason.
4.4 You agree to conduct yourself in a proper manner so as to not to cause disturbance or offence to other travellers and you agree to take responsibility for any damage you cause to our or any third party’s property.
4.5 We will not be responsible to you for any loss or damage sustained by you arising from or in relation to your contravention of any law of any place while on the holiday or attending the events provided by us. You indemnify us for all third party actions taken against us for loss or damage caused by you or arising from your participation on the holiday or attending the event.
4.6 On arrival at travel service location, property or event you may be required to supply a credit card for bond security purposes. If you do not have a credit card or one is not available, you may be required to pay a cash bond.
4.7 Tribal Schoolies will issue you a user name and password to participate in these programs and access details on the respective websites which you must ensure the user name and password is kept in a secure place and not available to the general public.
4.8 You warrant to Tribal Schoolies that you are the holder of the password used to access this site or have the authority of the password holder to use this site, and enter into a contract with Tribal Schoolies and various suppliers.
5.0 OUR ROLE AS AN AGENT
5.1 We act as an agent for and sell various travel related products, events or merchandise as an agent on behalf of numerous accommodation, travel service providers, event and merchandise providers as well as travel wholesalers.
5.2 Our obligation to you is to (and you expressly authorise us to) make travel or event bookings as your agent on your behalf and to arrange relevant contracts between you and travel service or event providers.
5.3 We exercise care in the selection of reputable service providers, but we are not ourselves a provider of travel services and have no control over, or liability for, the services provided by third parties.
5.4 All bookings are made on your behalf subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by these service providers.
5.5 We can provide you with copies of the relevant service provider terms and conditions on request.
5.6 Your legal rights in connection with the provision of travel services or event services are against the specific provider and, except to the extent a problem is caused by fault on our part, are not against us.
5.7 Specifically, if for any reason (excluding fault on our part) any travel service provider or event provider is unable to provide the services for which you have contracted, your rights are against that provider and not against us.
6.0 HOW TO BOOK
6.1 Book online at the Tribe Schoolies website or via our reservations staff on 1300 050 600.
6.2 All rates quoted are “per person” and are inclusive of GST and do not include bonds.
6.3 A deposit per person is required to secure your reservation.
6.4 If you would like to stay for more than 7 nights, it is possible to book 2 stays, but please be aware that these will be treated as two separate bookings and will require two separate bonds and deposits.
2.5 Payment of this deposit will indicate acceptance of the Terms and Conditions of our accommodation packages.
7.1 If you are under the age of 18 years of age, your parent or guardian must make the booking on your behalf.
7.2 If a booking is made and not authorised by your parent or guardian, the deposit paid at the time of booking will be forfeited.
7.3 By making a booking via Tribe Schoolies, whether or not on behalf of a minor, you are deemed to have accepted the Terms and Conditions.
8.0 THE ORGANISER
8.1 Booking on behalf of your friends and other students allows you to become the group organiser. All communications will them go to you and the responsibility of ensuring your friends details are correct rest with you.
8.2 It is your responsibility as the group organiser to ensure that all members of your group have read and understood the Terms & Conditions as well as the House Rules.
8.3 You will have the authority and responsibility to make changes to any details of the booking and Tribe Schoolies will accept these change. We expect that you have discussed any changes with your group as it is your duty to advise them.
8.4 We are not responsible for any discrepancies between you and/or your roommates.
9.1 All payments can be made via the Tribe Schoolies website www.tribeschoolies.com or with our reservations staff on 1300 050 600 by credit card or BPAY.
10.1 A non-refundable deposit of $200 per person must be received by us at time of booking.
The minimum amount of deposits required for your chosen room type must be received upon making the reservation otherwise your booking will not be held.
10.2 If you make multiple bookings to hold rooms you will not be refunded for any payments made on additional bookings.
10.3 By paying a deposit you agree that you have read, understood and will be bound by these Terms & Conditions.
10.4 If you are making a booking within 60 days of your travel date then you are required to pay all amounts including the Bond at the time of booking.
11.0 FINAL PAYMENT
11.1 The final payment including all Bonds is due 60 days prior to your arrival date.
11.2 It is your responsibility to ensure you make payment via the Tribe Schoolies website www.tribeschoolies.com or by phoning reservations prior to the due date (60 days prior to arrival).
11.3 If your booking is not paid in full by the due date Tribe Schoolies reserves the right to cancel the booking. Please refer to the Cancellation section for full details.
11.4 IMPORTANT: If your payment is overdue, the last Credit Card used to make a payment for a guest is the credit card that will be used to attempt to process your final payment. If you want to update the details of your credit card simply make another payment online at www.tribeschoolies.com
12.1 A $200 Bond per person is required 60 days prior to check in.
12.2 The Bond is held as security against any damage or undue wear and tear, additional cleaning, removal of excess rubbish, among other things.
12.3 All damage, breakages and losses to property, furniture, keys or furnishings that exceed the paid Bond amount must be paid for by the group and will be automatically charged to the credit card of each guest.
12.4 Any damage must be reported to the accommodation provider immediately.
12.5 It is the responsibility of the group to leave the property clean and tidy and in the same condition or as close as possible to the condition when you commenced your stay.
13.0 BOND REFUNDS
Important: To register for the refund of your Bond, you are required to login to the Tribe Schoolies website www.tribeschoolies.com with your username and password after check-out and enter the Bank Details (Name of Account, Bank, BSB and Account Number) you wish the Bond to be refunded to.
13.1 You agree that it is your (the guests) responsibility to ensure this process is completed and the details you provide are accurate. If the details you provide are inaccurate, fees will apply. Please see the Amendments & Fees section for more information.
13.2 Bonds will be available for refund approximately 14 days after your refund registration date, provided they have been given clearance from the accommodation houses concerned. Bonds will not be returned by any other means.
13.3 Please note: you will have up to 6 months after departure to claim your bond refund. After this time, all unclaimed bonds will be void.
14.1 Accommodation arrangements are based on using existing bedding. This may mean sharing a double bed. If this is not suitable you may be able to hire a fold out bed at your expense.
14.2 Tribe Schoolies makes every effort to ensure that the description of facilities and services of the hotels and apartments we sell is accurate, however these are continually being changed, upgraded and on occasion taken out of service.
14.3 We cannot be held liable for omissions, errors or alterations to a properties facilities and services whether temporary or permanent.
14.4 Any special requests made to properties cannot be guaranteed. Most of our apartments are privately owned and not operated by the resort management.
14.5 Our accommodation has a minimum and maximum person limit for each room type. The number of persons allowed per room is listed on the building information page.
14.6 If you need to change buildings or apartments due to insufficient persons per room you will incur a $50 amendment fee. Please see the Amendments & Fees section for more details.
14.7 Rooms may not exceed the maximum persons allowed due to fire and safety regulations.
14.8 If you are found to have exceeded the maximum persons allowed Tribe Schoolies and/or or the Offsite Managers reserves the right to evict you / the group from the apartment and the building.
15.1 A booking confirmation will be emailed to you on booking.
16.1 All guests are required to download, complete and return the following forms no later than 1 September:

16.2 Failure to do so will result in Fees. Please see the Amendments & Fees section for more information.
17.1 All guests are required to upload a passport quality photo (or similar) no later than 1 September for their Tribe Schoolies Building Pass. This means the photo must:
• Be a clear image of no less than 200KB
• Be in colour
• Show only one person in the frame from the shoulders up, showing their full face.
17.2 Not have sunglasses, silly/inappropriate faces, eyes closed etc.
17.3 Failure to do so or misuse of photo uploading will result in fees. Please see the Amendments & Fees section for more information.
18.1 Tribe Schoolies will at various times use images, names and non-personal data of guests attending the schoolies celebrations in either main stream media, digital or social media or other marketing channels for the purpose of promoting the Tribe brand or other advertising campaigns and reserves the right to use such material without further consent of the guest or any payment compensation.
19.0 HOUSE RULES
19.1 House Rules are the individual accommodation provider’s Terms & Conditions.
19.2 By confirming your booking you and all members of your group agree to abide by these House Rules for your stay.
20.0 PARTY TICKETS & EXTRAS
20.1 Party tickets are added to all bookings, ensure you remove them if you do not wish to purchase them. Payment for Cart items are made automatically with final balance and bonds.
20.2 Tickets are limited so please ensure you make payment for your tickets earlier as there are a maximum number of tickets to be sold. Once reached, no further tickets will be processed or sold.
20.3 If you do not wish to attend the exclusive schoolies parties please remove tickets prior to final balance.
20.4 Week 2 party tickets are only available to 18 years and over, if you are under 18 do not purchase the tickets as entry will not be allowed.
21.0 SCHOOLIES T-SHIRTS
21.1 All prices are inclusive of GST and are in Australian dollars. Tribe Schoolies reserves the right to change prices.
21.2 Your submittal of an online order is a conditional acceptance of Tribe Schoolies terms and conditions.
21.3 Full payment is required with your booking no later than 90 days before travel.
21.4 Production will not begin until full payment has been received.
21.5 It is your responsibility to log in and customise your singlets. If you do not do this, you will receive a blank singlet.
21.6 Customisations must be made online at least two (2) weeks prior to Schoolies.
21.7 If the name / nickname / group is entered incorrectly, Tribe Schoolies will not accept returns.
21.8 Refunds will not be available due to errors resulting from incorrect entry.
21.9 Please ensure you check the right sizes prior to ordering. Tribe Schoolies will not refund or exchange if the sizing that is selected is incorrect.
21.10 Tribe Schoolies will notify you of the designated collection point and specified time allotments.
21.11 No refunds will be offered if you fail to collect your singlets from the designated collection point in the specified time allotment.
21.12 Failure to attend Schoolies will not result in a refund.
22.1 Tribe Schoolies may run competitions/promotions at various times via main stream media, direct marketing or social media
22.2 Full Terms and Conditions for the promotion/competition will be published at that time.
22.3 The prizes will only be awarded to Australian residents, not employed by Youth Travel Pty Ltd (including affiliated companies) or family of employees or suppliers.
22.4 Participants are bound by the terms and conditions published at the time of the promotion/competition and only a single entry will be accepted, unless stated otherwise must be registered or hold a booking with Tribe Schoolies.
22.5 Prizes cannot be redeemed for cash, exchanged, transferred or resold though Tribe Schoolies reserves the right to substitute if the original prize is no longer available.
22.6 Winners will be notified by telephone or email.
AMENDMENTS, FEES & CANCELLATIONS
23.0 AMENDMENTS & FEES
23.1 You can make the following amendments to your booking via your login details via the Tribe Schoolies website www.tribeschoolies.com

• Mobile / Contact phone number
• Emergency phone number
• Date of Birth
• Admin Password
• Make Payments.
23.2 If you fail to submit your forms and photos by 1st September the following fees will apply.
(a) Forms: A $30 fee will apply per person.
(b) Photos: A $50 fee will apply per person. Misuse of photo uploading will incur an extra $30 fee.
23.3 If you wish to make any of the following changes, fees will apply:
(a) Change the name of a group member - there will be a $50 amendment fee.
(b) Cancel a group member - that person will forfeit their deposit.
23.4 We must be notified by the organiser as well as by the guest who is cancelling. If we are notified in writing that the person cancelling is being replaced by a new person entering the group, the deposit can then be transferred to the new person. The person affecting a booking shall be deemed to have accepted and by making the booking represents to us that he/she is authorised to accept the booking conditions on behalf of all persons named in the booking. A $50 fee will apply to change persons.
(c) Change buildings, room types or dates once a deposit has been received - you will incur a $50 amendment fee per person, per change. Amendments must be notified in writing via email by all roommates. Any building change will be subject to availability.
23.5 No change of buildings, names or apartments or other travel arrangements is permitted within 60 days prior to travel.
23.6 Tribe Schoolies or the Offsite Managers do not take responsibility over any discrepancies between roommates in regards to these changes.
24.1 Cancellations must be notified in writing or via email by the guest whose booking is being cancelled. Tribe Schoolies is not responsible for advising any other members of the group that a person in their party has cancelled.
(a) More than 60 days prior to travel: all monies paid will be forfeited.
(b) Less than 60 days prior to travel: 100% of the total cost will be forfeited.
(c) No refunds will be given for an early check-out.
25.1 If the refund details provided to us are inaccurate and paid to an incorrect person and/or account, you will need to contact your bank to rectify this.
25.2 If the bank details are inaccurate and the payment cannot be processed, a $10 administration fee will apply per attempt.
26.0 TRAVEL INSURANCE
26.1 Tribe Schoolies strongly recommend you purchase Travel Insurance at the time of booking.
26.2 This can be booked online at www.TribeSchoolies.com
26.3 If, having purchased the policy, you want to return it, you can do so within 14 days of receiving the Certificate of Insurance and obtain a full refund, provided no right or power has been exercised under it by you (e.g. no claim has been made) and your trip has not commenced.
26.4 Please be advised that the travel insurance you are purchasing is being bought and paid directly to the insurance provider and any issues with your travel insurance policy must be addressed directly with them.
26.5 The copy of the travel insurance policy you purchased is provided by the insurance provider.
27.1 The prices stated are “per person” and quoted in the stipulated currency throughout the website.
27.2 They are inclusive of GST where applicable. Tribe Schoolies reserves the right to amend prices at any time without notice.
27.3 Charges and Fees are subject to change, therefore the package price may vary between time of deposit and time of final payment.
28.1 Tribe Schoolies is operated by Youth Travel Pty Ltd.
28.2 Tribe Schoolies and Youth Travel organises and arranges the accommodation pursuant to contractual arrangements it has with apartment managers and owners.
28.3 Tribe Schoolies and Youth Travel does not occupy or have any control over any hotel or apartment and as such is not liable for any damage or loss, whether to person or property and howsoever arising, to any person who has booked accommodation through Tribe Schoolies.
28.4 Tribe Schoolies and Youth Travel cannot guarantee the availability of accommodation and does reserve the right to change bookings. Although bookings for apartments are managed by Tribe Schoolies and Youth Travel, the final decision as to the availability of the unit for rental rests with the owners and Offsite Managers. Should owners withdraw their units from the rental pool, Tribe Schoolies and Youth Travel will use its best endeavours to offer alternative accommodation at no extra cost to those whose bookings have been affected. If Tribe Schoolies and Youth Travel concludes that it is not able to offer alternative accommodation, those whose bookings have been affected will be entitled to a refund of any monies paid.
28.5 Tribe Schoolies and Youth Travel organises travel arrangements as agents on behalf of their principals and shall not be liable under any circumstances for any failure by those principals to fulfil such travel arrangements nor for any alteration or change of any kind made by those principals following the acceptance of the booking by them and you will be responsible at all times for any increases and any changes imposed by those principals.
28.6 Tribe Schoolies and Youth Travel both for itself and on the behalf of their employees or agents do not accept any responsibility for any act, omission, default or neglect of themselves, their employees or agents for injury, damage, or loss to persons or goods whatsoever or however the same may be caused and they do not warrant and are in no way responsible for the accuracy of any information given in statement made by their principals in terms of travel arrangement.
28.7 Tribe Schoolies and Youth Travel reserves the right to at any time and in its absolute discretion modify any accommodation or travel arrangements and to cancel the same without notice. The information you provide may be used to send information to you on products of interest.
28.8 Tribe Schoolies only accepts instructions on the above terms.
29.0 Tribe Mystery Deals
29.1 All bookings for Mystery deal - are final and cannot be changed or transferred.
29.2 Mystery deal is for new bookings only.
30.0 Secret Tribe Hotels
30.1 Booking of Secret Tribe Hotels are for new bookings only.
30.2 Bookings are covered by our normal booking terms and conditions contained within this document.
30.3 Tribe Schoolies guarantees that any bookings made on the Secret Tribe Hotels will fit the purpose as described and requested by the guest.
30.4 The name of the accommodation property, address and any special booking information will be released by Tribe Schoolies 30 days prior to arrival or if the booking is made within that 30 day period, 7 days after final payment.
30.5 Booking made on Secret Tribe Schoolies Hotels cannot be changed, transferred, refunded except in certain circumstances as per conditions under changes to booking.
30.6 Any upgrades or requested options are subject to availability and Tribe Schoolies will advise before 30 days prior to arrival unless booking is made within the 30 day period.
31.0 Tribe Schoolies Flash Sale
31.1 Flash Sale prices and discounts are at the discretion of Tribe Schoolies, subject to availability and can be withdrawn or modified without notice.
31.2 Flash Sale prices are for new booking only and subject to normal booking terms and conditions contained within this document.
31.3 Unless stated all Flash Sale prices are for the accommodation only and do not include VIP packs, merchandise, events or bonds
